Terms and Conditions

This RenoSync Contractor/Vendor Terms and Conditions Agreement ("Agreement") governs participation in RenoSync by contractors, vendors, service providers, businesses, and their respective owners, employees, representatives, subcontractors, and agents ("Contractor," "Vendor," "you," or "your").

RenoSync is created and operated by Pacific Roofing and Renovations LLC ("Pacific Roofing," "RenoSync," "we," "us," or "our") as a contractor-matching and appointment-scheduling platform designed to assist homeowners, property owners, tenants, property managers, and other authorized persons ("Customers") in locating Contractors and Vendors who may be able to assist with requested projects or services.

By registering for RenoSync, maintaining a RenoSync profile, accessing the platform, receiving a lead, approving or accepting an appointment, viewing Customer information, or otherwise participating in RenoSync, you acknowledge that you have read, understand, and agree to this Agreement and the RenoSync Contractor/Vendor Privacy and Customer Data Policy.

1. Purpose of RenoSync

RenoSync is a contractor-matching, referral, and appointment-scheduling platform.

RenoSync may match Customers with Contractors/Vendors using factors including:

  • Services requested;
  • Project description;
  • Service category;
  • Customer location;
  • Contractor service area;
  • Customer language preference;
  • Contractor language capabilities;
  • Contractor availability;
  • Contractor profile information;
  • Platform activity;
  • Customer preferences; and
  • Other matching or operational criteria determined by RenoSync.

RenoSync does not guarantee any minimum number of leads, appointments, Customers, estimates, projects, contracts, revenue, or completed jobs.

2. Contractor/Vendor Participation Is Not Guaranteed

Participation in RenoSync is a privilege offered at the discretion of Pacific Roofing and RenoSync and does not create a permanent right to participate in, appear on, or receive leads through RenoSync.

Pacific Roofing and RenoSync reserve the right, to the fullest extent permitted by applicable law, to determine which Contractors/Vendors are approved, displayed, promoted, limited, suspended, denied, or removed from RenoSync.

Pacific Roofing and RenoSync may approve or deny participation based on legitimate business, operational, safety, quality, customer-service, compliance, geographic, or platform considerations.

3. Contractor Visibility, Promotion, and Service Area Discretion

Pacific Roofing and RenoSync reserve the right to determine where, when, and how a Contractor/Vendor or its services appear within RenoSync.

Pacific Roofing and RenoSync may, at their discretion:

  • Approve or deny a Contractor/Vendor's participation;
  • Suspend, restrict, or remove a Contractor/Vendor;
  • Decline to display or promote one or more services offered by a Contractor/Vendor;
  • Limit the geographic areas in which a Contractor/Vendor is displayed;
  • Decline a request to be promoted within a particular city, ZIP code, county, region, or service territory;
  • Restrict a Contractor/Vendor from certain service categories;
  • Modify Contractor/Vendor visibility within Customer search or matching results;
  • Limit the type or number of appointments made available;
  • Prioritize or deprioritize Contractors based on legitimate platform criteria; and
  • Modify geographic coverage or service availability as RenoSync determines reasonably appropriate.

A Contractor/Vendor's request to serve a particular geographic area does not guarantee that RenoSync will display or promote that Contractor/Vendor in that area.

RenoSync may determine that a requested service area is too broad, outside a reasonable operating area, inconsistent with the Contractor/Vendor's profile or qualifications, adequately served by other Contractors/Vendors, incompatible with RenoSync's platform objectives, or otherwise unsuitable for promotion.

Nothing in this Agreement guarantees:

  • Placement;
  • Ranking;
  • Search visibility;
  • Geographic coverage;
  • Lead volume;
  • Appointment volume;
  • Exclusivity;
  • Preferred-provider status; or
  • Continued participation.

Pacific Roofing and RenoSync are not required to disclose proprietary algorithms, ranking methods, matching criteria, internal platform rules, or confidential business methods except where disclosure is required by law.

4. Appointment and Information Exchange

Before an appointment is accepted, certain identifying information regarding the Customer or Contractor/Vendor may be limited or withheld.

Once a Customer schedules an inspection or appointment and the Contractor/Vendor approves or accepts that appointment, RenoSync may make identifying and contact information available to both parties.

The Customer may then be able to view information concerning the selected Contractor/Vendor, and the Contractor/Vendor may be able to view information concerning the Customer and requested project.

Customer information may include:

  • Name;
  • Telephone number;
  • Email address;
  • Property or service address;
  • Project description;
  • Requested services;
  • Preferred language;
  • Appointment information;
  • Photographs;
  • Documents;
  • Customer notes; and
  • Other information voluntarily submitted through RenoSync.

Contractor/Vendor information displayed to the Customer may include:

  • Business name;
  • Representative name;
  • Telephone number;
  • Email address;
  • Service categories;
  • Service area;
  • Language capabilities;
  • License or registration information supplied to RenoSync;
  • Ratings and reviews; and
  • Other relevant business information.

5. Acceptance of an Appointment Creates Data Responsibilities

By approving or accepting an appointment, you acknowledge that Customer information may be disclosed to you for the limited purpose of:

  • Verifying the lead;
  • Contacting the Customer;
  • Confirming the appointment;
  • Evaluating the project;
  • Preparing an estimate;
  • Conducting an inspection;
  • Performing requested services; or
  • Communicating regarding the Customer's project.

Once Customer information has been properly provided to you following an accepted appointment, you are responsible for safeguarding the information while it is within your possession, custody, or control.

Pacific Roofing and RenoSync remain responsible for their own handling of information within systems and activities under their control.

However, Pacific Roofing and RenoSync do not control your independent handling of Customer information after it has been properly provided to you.

6. Customer Information Is Confidential

All Customer information received through RenoSync must be treated as confidential.

You may not:

  • Sell Customer information;
  • Rent Customer information;
  • Trade Customer information;
  • Provide Customer information to a lead broker;
  • Transfer Customer information for compensation;
  • Upload Customer information to a database for resale;
  • Sell Customer phone numbers or email addresses;
  • Disclose Customer information to unauthorized third parties;
  • Use Customer information for unrelated mass marketing;
  • Publish Customer information;
  • Post Customer information publicly;
  • Use Customer information for fraud or identity theft;
  • Harass or threaten a Customer using information obtained through RenoSync; or
  • Otherwise misuse Customer information.

Customer information may be used only for legitimate purposes connected with the Customer's service request unless the Customer provides separate, legally valid consent for another use.

7. No Resale or Unauthorized Transfer of Leads

A RenoSync lead is provided for use in connection with the particular Customer request associated with that lead.

You may not resell, redistribute, transfer, sublicense, publish, or commercially exploit a RenoSync lead.

You may provide Customer information to an employee, estimator, salesperson, subcontractor, or other representative only when reasonably necessary to respond to or perform the Customer's requested service.

You remain responsible for ensuring that persons receiving Customer information through your business comply with this Agreement and the RenoSync Contractor/Vendor Privacy and Customer Data Policy.

8. Contractor/Vendor Responsibility for Privacy

You agree to act in good faith and take reasonable measures to protect Customer information from:

  • Unauthorized access;
  • Unauthorized disclosure;
  • Loss;
  • Theft;
  • Improper copying;
  • Misuse;
  • Improper sale;
  • Improper transfer;
  • Accidental disclosure; and
  • Other unauthorized use.

You are responsible for the acts and omissions of your owners, employees, salespersons, estimators, subcontractors, independent contractors, agents, and representatives regarding Customer information to the extent provided by applicable law.

9. Privacy Violations and Contractor Liability

If Customer information under your control is sold, intentionally misused, unlawfully disclosed, improperly transferred, or inadequately protected in violation of applicable law or this Agreement, you are responsible for your conduct and the conduct of persons acting under your authority to the extent provided by law.

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Pacific Roofing and Renovations LLC, RenoSync, and their respective owners, members, managers, employees, representatives, affiliates, and service providers from third-party claims, damages, losses, penalties, costs, and reasonable attorneys' fees arising from:

  • Your unauthorized use of Customer information;
  • Your unauthorized sale or transfer of Customer information;
  • Your violation of privacy or data-security law;
  • Your failure to reasonably safeguard information;
  • Your employees', representatives', or subcontractors' misuse of Customer information; or
  • Your breach of the RenoSync privacy requirements.

Nothing in this Agreement requires indemnification where prohibited by law.

10. Required Data Security

You agree to maintain reasonable administrative, technical, and physical safeguards appropriate to the information you receive.

Reasonable measures should include, where applicable:

  • Password-protected accounts and devices;
  • Unique login credentials;
  • Appropriate access restrictions;
  • Device locking;
  • Software and security updates;
  • Protection against malware;
  • Restricting Customer information to authorized personnel;
  • Secure disposal of Customer records;
  • Avoiding unnecessary downloading or copying of Customer information; and
  • Training employees and representatives who handle Customer information.

The FTC recommends limiting employee access to personal information based on legitimate business need and placing security expectations for service providers in written agreements.

11. Data Breach or Security Incident

If you discover or reasonably suspect that Customer information received through RenoSync has been:

  • Lost;
  • Stolen;
  • Hacked;
  • Improperly accessed;
  • Disclosed without authorization;
  • Sent to an incorrect person;
  • Sold;
  • Improperly transferred; or
  • Otherwise compromised,

you must promptly notify Pacific Roofing and RenoSync.

You must reasonably cooperate with investigation, mitigation, legally required notifications, and remediation.

You may not intentionally conceal a known security or privacy incident affecting RenoSync Customers.

Washington, for example, imposes notification obligations in connection with certain breaches involving Washington residents' personal information.

12. Leads May Be False, Inaccurate, or Fraudulent

You acknowledge that RenoSync relies on information submitted by Customers and other users.

Pacific Roofing and RenoSync do not guarantee that every lead is genuine, accurate, authorized, complete, or submitted by the lawful owner or authorized occupant of a property.

A lead may contain:

  • A false name;
  • Incorrect telephone number;
  • Incorrect email address;
  • Incorrect address;
  • Fake project information;
  • Fraudulent information;
  • An unauthorized appointment request;
  • A prank request;
  • Duplicate information;
  • A vacant or abandoned property;
  • Information submitted by someone who does not own or control the property; or
  • Other inaccurate information.

13. Contractor/Vendor Must Verify Every Lead

It is the Contractor/Vendor's responsibility to independently verify a lead before traveling to the property.

Verification should reasonably include:

  • Contacting the Customer;
  • Confirming the appointment;
  • Confirming the address;
  • Confirming the requested service;
  • Confirming that someone authorized to provide property access will be available; and
  • Resolving suspicious or inconsistent information before traveling.

Pacific Roofing and RenoSync do not guarantee Customer identity, property ownership, property-control rights, or the accuracy of information submitted by a Customer.

14. No Liability for False or Unverified Leads

To the fullest extent permitted by law, Pacific Roofing and RenoSync are not responsible for losses arising solely from false, inaccurate, canceled, duplicate, unauthorized, or fraudulent leads.

This may include:

  • Mileage;
  • Fuel;
  • Lost time;
  • Labor costs;
  • Travel expenses;
  • Missed opportunities;
  • Customer no-shows; or
  • Other expenses associated with pursuing a lead.

15. Property Access

A RenoSync appointment does not itself constitute legal permission to enter a home, building, fenced area, locked area, or other private portion of a property.

A property owner, authorized tenant, authorized property manager, or other person legally authorized to grant access must provide permission.

Contractors/Vendors must not:

  • Force entry;
  • Enter a residence without permission;
  • Bypass a locked gate;
  • Enter a locked structure without permission;
  • Circumvent security devices;
  • Enter restricted areas without authorization; or
  • Assume that a RenoSync appointment proves property ownership.

16. Customer or Authorized Person Should Be Present

Contractors/Vendors should confirm that a Customer, property owner, authorized tenant, property manager, or other authorized adult will be available to provide necessary property access.

You must not rely solely on the existence of the RenoSync appointment as authorization to enter private property.

17. Verification of Ownership and Permission

RenoSync does not guarantee that a person submitting a request:

  • Owns the property;
  • Is an authorized tenant;
  • Has permission from the owner;
  • Is an authorized property manager; or
  • Has authority to permit entry.

You assume responsibility for reasonably confirming permission before entering restricted portions of the property or beginning work.

18. Trespass and Unauthorized Entry

To the fullest extent permitted by law, Pacific Roofing and RenoSync are not responsible for claims resulting from a Contractor/Vendor's unauthorized entry onto or into property.

You agree to accept responsibility for obtaining appropriate access permission.

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Pacific Roofing and RenoSync from third-party claims arising from your trespass, unauthorized entry, or failure to obtain appropriate permission.

19. Independent Businesses

Participating Contractors/Vendors are independent businesses.

Participation in RenoSync does not, by itself, create an:

  • Employer-employee relationship;
  • Agency relationship;
  • Partnership;
  • Joint venture;
  • Franchise relationship; or
  • Exclusive service relationship.

The actual legal relationship between the parties will be determined by applicable law and the actual facts and circumstances.

20. Licensing, Registration, Bonding, and Insurance

You are responsible for maintaining all licenses, registrations, bonds, insurance policies, permits, certifications, and qualifications legally required for the services you offer.

You agree not to accept work that you are legally prohibited or unqualified to perform.

You are responsible for compliance with applicable:

  • Contractor licensing laws;
  • Business registration requirements;
  • Specialty trade licensing laws;
  • Bond requirements;
  • Insurance requirements;
  • Workers' compensation requirements;
  • Employment laws;
  • Building codes;
  • Permit requirements;
  • Inspection requirements; and
  • Other local, state, and federal laws.

RenoSync may collect credential information but does not guarantee continuous independent verification of every Contractor/Vendor's credentials unless RenoSync expressly states otherwise.

21. Contractor Information Must Be Accurate

You agree to provide complete and reasonably accurate information regarding your:

  • Business identity;
  • Contact information;
  • Services;
  • Service area;
  • Licensing or registration;
  • Insurance;
  • Bonding;
  • Certifications;
  • Languages offered; and
  • Other profile information.

You must promptly update material changes.

You may not knowingly misrepresent your qualifications, licenses, business identity, employees, experience, insurance, services, or geographic coverage.

22. Appointment Responsibility

When you accept an appointment, you assume responsibility for your conduct and the conduct of personnel acting on your behalf.

You are responsible for:

  • Verifying the appointment;
  • Communicating with the Customer;
  • Traveling safely and lawfully;
  • Obtaining permission before entry;
  • Respecting Customer property;
  • Following safety requirements;
  • Properly using tools and equipment;
  • Supervising employees and subcontractors;
  • Obtaining necessary authorizations before testing or destructive inspection; and
  • Complying with applicable laws.

23. Property Damage and Bodily Injury

Pacific Roofing and RenoSync do not supervise Contractor/Vendor inspections, estimates, employees, subcontractors, vehicles, tools, equipment, or work at the Customer's property.

To the fullest extent permitted by applicable law, you accept responsibility for injury, property damage, loss, or other harm resulting from your acts or omissions or those of persons acting under your authority.

This may include:

  • Property damage;
  • Bodily injury;
  • Ladder-related damage;
  • Vehicle damage;
  • Landscaping damage;
  • Damage caused during inspection;
  • Interior damage;
  • Water intrusion;
  • Electrical damage;
  • Damage from equipment;
  • Damage caused by subcontractors; or
  • Other losses attributable to Contractor/Vendor conduct.

24. No Guarantee of Lead Quality or Project Value

RenoSync does not guarantee that:

  • A Customer will answer;
  • A Customer will attend;
  • A project actually exists;
  • A Customer will hire you;
  • The project description is accurate;
  • The Customer owns the property;
  • You will receive a particular project value;
  • An estimate will be accepted;
  • A Customer will make payment; or
  • A lead will result in revenue.

Contractors/Vendors assume the normal business risk associated with evaluating potential customers.

25. Estimates, Contracts, Work, and Payments

Unless RenoSync expressly agrees otherwise in writing, any:

  • Estimate;
  • Proposal;
  • Construction contract;
  • Work authorization;
  • Change order;
  • Invoice;
  • Payment;
  • Deposit;
  • Financing agreement;
  • Warranty; or
  • Other agreement

is solely between the Contractor/Vendor and the Customer.

Pacific Roofing and RenoSync are not parties to those agreements solely because RenoSync facilitated the introduction or appointment.

26. Customer Reviews and Ratings

Customers may voluntarily submit reviews and ratings following appointments.

You acknowledge that:

  • Reviews may be positive or negative;
  • Customers are not required to submit reviews;
  • Review volume may not equal appointment volume;
  • Contractors without submitted feedback may appear as unrated or zero-rated; and
  • RenoSync does not guarantee any particular rating.

You may not:

  • Threaten Customers over reviews;
  • Harass Customers regarding reviews;
  • Retaliate against Customers for legitimate reviews;
  • Purchase reviews conditioned on positive sentiment;
  • Submit false Customer reviews; or
  • Manipulate RenoSync's review system.

You may report feedback reasonably believed to be fraudulent, abusive, unrelated to an actual interaction, or otherwise inconsistent with RenoSync policies.

27. Good-Faith Conduct

Contractors/Vendors must act professionally and in good faith.

You agree not to:

  • Exploit Customers;
  • Misrepresent credentials;
  • Use deceptive sales practices;
  • Discriminate in violation of applicable law;
  • Harass Customers;
  • Threaten Customers;
  • Misuse Customer information;
  • Engage in unlawful conduct;
  • Circumvent RenoSync security;
  • Access another Contractor/Vendor's leads without authorization;
  • Manipulate reviews; or
  • Use RenoSync for fraudulent purposes.

28. Appointment and Lead Tracking

RenoSync may maintain records concerning:

  • Leads generated;
  • Contractor matches;
  • Contractors displayed;
  • Customer selections;
  • Appointment creation;
  • Appointment acceptance;
  • Appointment rejection;
  • Date and time of acceptance;
  • Account activity;
  • Appointment status;
  • Customer feedback; and
  • Other relevant platform activity.

These records may be used for:

  • Privacy investigations;
  • Security;
  • Fraud prevention;
  • Customer support;
  • Dispute resolution;
  • Contractor accountability;
  • Platform quality;
  • Enforcement of this Agreement; and
  • Compliance with legal obligations.

29. Contractor/Vendor Suspension, Restriction, or Removal

Pacific Roofing and RenoSync may restrict, suspend, deny, or terminate a Contractor/Vendor's access when reasonably appropriate.

Reasons may include suspected or confirmed:

  • Privacy violations;
  • Data-security violations;
  • Sale of Customer information;
  • Fraud;
  • Misrepresentation;
  • Customer harassment;
  • Repeated complaints;
  • Unsafe conduct;
  • Unauthorized property entry;
  • Unlicensed activity;
  • Review manipulation;
  • Platform abuse;
  • Failure to maintain accurate information;
  • Failure to meet platform standards; or
  • Material breach of this Agreement.

Pacific Roofing and RenoSync may also elect not to promote or continue promoting a Contractor/Vendor for legitimate business reasons even when no misconduct has occurred.

30. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Pacific Roofing and Renovations LLC, RenoSync, their owners, members, managers, employees, affiliates, representatives, and service providers from third-party claims, damages, liabilities, penalties, losses, costs, and reasonable attorneys' fees arising from or relating to your:

  • Work;
  • Inspection activities;
  • Property damage;
  • Bodily injury;
  • Unauthorized entry;
  • Privacy violation;
  • Data breach;
  • Unauthorized use of Customer information;
  • Misrepresentation;
  • Violation of law;
  • Employee conduct;
  • Subcontractor conduct;
  • Contract with a Customer; or
  • Breach of this Agreement.

This provision applies only to the extent permitted by law.

31. Limitation of Pacific Roofing and RenoSync Liability

To the fullest extent permitted by applicable law, Pacific Roofing and RenoSync are not liable for losses caused solely by:

  • Fake or inaccurate leads;
  • Customer no-shows;
  • Customer misrepresentations;
  • Customer nonpayment;
  • Property-ownership disputes;
  • Contractor travel costs;
  • Contractor lost revenue;
  • Contractor-Customer contract disputes;
  • Unauthorized entry by a Contractor;
  • Damage caused by a Contractor;
  • Contractor privacy violations; or
  • Contractor conduct occurring after Customer information has been properly disclosed.

Pacific Roofing and RenoSync remain responsible for obligations that applicable law does not permit them to disclaim or transfer.

32. Insurance

Contractors/Vendors are responsible for determining and maintaining insurance appropriate to their business and legally required for their services.

Depending on the business, appropriate coverage may include:

  • Commercial general liability insurance;
  • Commercial automobile insurance;
  • Workers' compensation coverage;
  • Professional liability coverage;
  • Errors-and-omissions insurance; and
  • Cyber/privacy liability insurance.

33. Changes to This Agreement

Pacific Roofing and RenoSync may modify this Agreement from time to time.

RenoSync may require Contractors/Vendors to accept updated Terms before continuing to receive or approve appointments.

34. Governing Law

This Agreement will be governed by the laws of the State of Oregon, except where mandatory law requires otherwise.

35. Severability

If any provision is determined to be invalid or unenforceable, the remaining provisions will remain effective to the fullest extent permitted by applicable law.

36. Entire Agreement Regarding RenoSync Participation

This Agreement, together with the RenoSync Contractor/Vendor Privacy and Customer Data Policy and other applicable platform policies or written agreements, governs Contractor/Vendor participation in RenoSync.

37. Contractor/Vendor Acceptance

By selecting "I Agree," "Accept Terms," "Approve," or by accepting a RenoSync appointment, you acknowledge and agree that:

  • You have read and understand this Agreement;
  • Customer information is confidential;
  • You will not sell Customer information;
  • You will not improperly disclose Customer information;
  • You will protect Customer information using reasonable safeguards;
  • You are responsible for authorized employees, agents, and subcontractors who receive Customer information through your business;
  • You understand RenoSync may track lead assignment and appointment acceptance;
  • You will promptly report suspected privacy or security incidents;
  • You understand leads may be inaccurate, fraudulent, unauthorized, or false;
  • You will independently verify leads before traveling;
  • You will confirm appropriate permission before entering private property;
  • You understand a RenoSync appointment itself does not authorize entry into a home or restricted area;
  • You accept responsibility for your acts and omissions during RenoSync appointments;
  • You are responsible for maintaining applicable licenses, registrations, bonds, insurance, permits, and qualifications;
  • You understand RenoSync does not guarantee lead quality, lead volume, project value, or revenue;
  • You understand Pacific Roofing and RenoSync may approve, deny, limit, suspend, remove, prioritize, or decline to promote Contractors/Vendors;
  • You understand RenoSync may decline to promote your services in a particular city, ZIP code, county, region, or service area;
  • You have no guaranteed right to placement, geographic coverage, ranking, leads, appointments, or continued participation;
  • You agree to act professionally and in good faith;
  • You agree to comply with the RenoSync Contractor/Vendor Privacy and Customer Data Policy; and
  • You agree to these Terms and Conditions.

Acceptance of these Terms is required before receiving Customer contact information or accepting RenoSync appointments.

RenoSync Contractor/Vendor Privacy and Customer Data Policy

This Contractor/Vendor Privacy and Customer Data Policy ("Privacy Policy") applies to all Contractors, Vendors, businesses, owners, employees, agents, subcontractors, representatives, and other persons receiving access to Customer information through RenoSync.

This Privacy Policy forms part of the RenoSync Contractor/Vendor Terms and Conditions Agreement.

1. Purpose

RenoSync provides Contractors/Vendors with limited access to Customer information so they can respond to legitimate Customer service requests.

Customer information must be protected and used only for authorized purposes related to the Customer's request.

Oregon requires covered businesses to maintain reasonable safeguards designed to protect the security, confidentiality, and integrity of certain personal information.

2. When Customer Information Becomes Available

A Customer may initially submit a project request without all identifying information being visible to participating Contractors/Vendors.

After the Customer requests an appointment and the Contractor/Vendor approves or accepts the appointment, RenoSync may release identifying and contact information to the Customer and Contractor/Vendor.

At that point:

  • The Customer may receive identifying and business information concerning the selected Contractor/Vendor; and
  • The Contractor/Vendor may receive Customer contact, property, project, and scheduling information.

The Contractor/Vendor assumes responsibility for reasonably safeguarding Customer information while it is within the Contractor/Vendor's possession or control.

3. Customer Information Covered by This Policy

Customer information may include:

  • Name;
  • Telephone number;
  • Email address;
  • Property or service address;
  • Project description;
  • Requested services;
  • Preferred language;
  • Appointment details;
  • Photographs;
  • Documents;
  • Customer notes; and
  • Other information provided in connection with the service request.

4. Permitted Uses

Customer information may be used only as reasonably necessary to:

  • Verify the lead;
  • Contact the Customer;
  • Confirm an appointment;
  • Understand the requested work;
  • Determine whether you can provide the requested service;
  • Travel to the proper service location;
  • Conduct an authorized inspection;
  • Prepare an estimate;
  • Prepare a proposal;
  • Perform requested work;
  • Communicate regarding the project;
  • Maintain records required by law; and
  • Respond to legitimate Customer inquiries.

5. Prohibited Uses

You may not:

  • Sell Customer information;
  • Rent Customer information;
  • Trade Customer information;
  • Provide Customer information to lead brokers;
  • Sell Customer phone numbers;
  • Sell Customer email addresses;
  • Sell Customer addresses;
  • Upload Customer information to databases intended for resale;
  • Transfer leads to unrelated Contractors without authorization;
  • Use Customer information for unrelated mass marketing without legally sufficient consent;
  • Publish Customer information;
  • Post Customer information on social media;
  • Harass or threaten Customers;
  • Use Customer information for fraud;
  • Use Customer information for identity theft; or
  • Allow unauthorized individuals to access Customer information.

6. No Lead Resale

RenoSync Customer information is provided for the Customer's particular service request and is not a resale product.

You may not accept an appointment for the purpose of reselling, brokering, transferring, or commercially exploiting the Customer's information.

7. Employees, Agents, and Subcontractors

Customer information may be shared internally only with persons who reasonably require it to perform the Customer's requested service.

This may include:

  • Employees;
  • Estimators;
  • Sales representatives;
  • Office personnel;
  • Subcontractors;
  • Agents; or
  • Other authorized representatives.

You must ensure those persons understand that RenoSync Customer information is confidential.

The Contractor/Vendor remains responsible for information shared with persons acting under or on behalf of the Contractor/Vendor to the extent provided by applicable law.

8. Minimum Security Practices

Contractors/Vendors must maintain reasonable safeguards appropriate for the Customer information they receive.

Safeguards should include, where appropriate:

  • Password-protected devices;
  • Secure RenoSync credentials;
  • Unique passwords;
  • Device screen locks;
  • Updated operating systems;
  • Antivirus or endpoint security;
  • Restricting access based on business need;
  • Securing printed Customer records;
  • Properly disposing of unnecessary records; and
  • Promptly disabling access for personnel who no longer require it.

The FTC recommends limiting access to personal information to personnel with a legitimate business need and requiring service providers to follow written security requirements.

9. RenoSync Account Security

Your RenoSync credentials may only be used by authorized persons.

You must not knowingly give account credentials to unauthorized individuals.

If you believe an account or password has been compromised, you must take reasonable steps to secure the account and promptly notify RenoSync if Customer information may have been exposed.

10. Lost or Stolen Devices

If a phone, computer, tablet, storage device, printed document, or other item containing RenoSync Customer information is lost or stolen, you must take reasonable steps to secure affected accounts and information.

Where Customer information may have been exposed, you must promptly notify RenoSync.

11. Privacy or Security Incidents

You must promptly notify Pacific Roofing and RenoSync if you discover or reasonably suspect:

  • Unauthorized access;
  • Unauthorized disclosure;
  • Customer data sent to the wrong recipient;
  • Lost Customer information;
  • Stolen Customer information;
  • Compromised credentials;
  • Unauthorized sale;
  • Unauthorized transfer;
  • Malware affecting Customer records; or
  • Any other event reasonably likely to compromise Customer information.

You must reasonably cooperate in investigation, remediation, mitigation, and legally required notifications.

Washington law imposes consumer and, in certain circumstances, Attorney General notification requirements following qualifying breaches.

12. Customer Privacy Requests

If a Customer contacts you regarding access, correction, deletion, or another privacy request relating to information received through RenoSync, you must respond appropriately under applicable law and reasonably cooperate with RenoSync where necessary.

Oregon's Consumer Privacy Act provides qualifying Oregon consumers with rights regarding personal data when the Act applies to the business processing that data.

13. Data Retention

Customer information should be retained only for as long as reasonably necessary for legitimate business or legal purposes.

When information is no longer reasonably necessary, you should securely:

  • Delete it;
  • Destroy it; or
  • Deidentify it where appropriate.

Customer lead information should not be kept indefinitely merely for speculative future marketing use.

14. Marketing Communications

Customer information is initially provided because the Customer requested a specific service.

A RenoSync appointment should not automatically be interpreted as consent to unrelated marketing campaigns.

The Contractor/Vendor is responsible for obtaining any additional consent legally required for promotional emails, telephone calls, text messages, or other marketing communications.

15. Customer Photographs and Documents

Customer photographs, plans, inspection materials, documents, and other project information may contain private or identifying information.

You may not publicly post or use Customer-provided materials in:

  • Advertisements;
  • Social media;
  • Websites;
  • Promotional materials;
  • Portfolios; or
  • Other public content

without appropriate permission when permission is required.

16. Customer Address Confidentiality

A Customer's service address should be made available only to persons who reasonably need it to respond to or perform the requested service.

You must not unnecessarily publish, distribute, or disclose Customer addresses.

17. No Employee or Representative Ownership of Leads

Employees, salespersons, representatives, subcontractors, and agents may not remove or copy RenoSync Customer information for personal use or resale.

Customer information obtained through the Contractor/Vendor must remain within authorized business processes.

18. Lead and Appointment Tracking

RenoSync may maintain records showing:

  • Which Contractors were presented to a Customer;
  • Which Contractor the Customer selected;
  • Which Contractor accepted the appointment;
  • Date and time of acceptance;
  • Customer selection;
  • Contractor account information;
  • Appointment status;
  • Platform communications where available; and
  • Related system activity.

These records may be used for:

  • Privacy investigations;
  • Complaint handling;
  • Fraud prevention;
  • Customer support;
  • Platform enforcement;
  • Data-security investigations;
  • Contractor accountability; and
  • Legal compliance.

19. Contractor/Vendor Accountability

The Contractor/Vendor that approves or accepts an appointment is responsible for reasonably protecting Customer information made available through that appointment while the information remains in the Contractor/Vendor's possession or control.

If a privacy violation results from the Contractor/Vendor's actions or the actions of persons under its authority, the Contractor/Vendor is responsible for its conduct to the extent provided by applicable law.

20. Pacific Roofing and RenoSync Responsibilities

Pacific Roofing and RenoSync remain responsible for their own collection, use, storage, disclosure, and protection of Customer information where that information remains within systems or activities under their control.

Once Customer information is properly disclosed to a Contractor/Vendor following Customer selection and Contractor/Vendor acceptance, Pacific Roofing and RenoSync do not control the Contractor/Vendor's independent handling of that information.

To the fullest extent permitted by law, Pacific Roofing and RenoSync are not responsible for an independent Contractor/Vendor's unauthorized sale, misuse, disclosure, loss, or improper handling of Customer information after proper disclosure.

Nothing in this Policy limits an obligation or responsibility that applicable law does not permit Pacific Roofing or RenoSync to disclaim.

21. Contractor/Vendor Indemnification for Privacy Violations

To the fullest extent permitted by applicable law, the Contractor/Vendor agrees to defend, indemnify, and hold harmless Pacific Roofing and Renovations LLC, RenoSync, their owners, members, managers, employees, representatives, affiliates, and service providers from third-party claims, damages, liabilities, penalties, costs, and reasonable attorneys' fees arising from:

  • Unauthorized sale of Customer information;
  • Unauthorized disclosure;
  • Privacy violations;
  • Data-security violations;
  • Failure to reasonably safeguard Customer information;
  • Unauthorized employee or subcontractor conduct;
  • Data breaches caused by the Contractor/Vendor;
  • Unlawful use of Customer information; or
  • Breach of this Policy.

22. Investigations

RenoSync may investigate suspected misuse of Customer information.

Contractors/Vendors agree to reasonably cooperate with legitimate investigations relating to Customer information received through RenoSync.

This cooperation may include identifying which authorized personnel received access to a particular Customer lead.

23. Violations of This Policy

Violation of this Privacy Policy may result in:

  • Warning;
  • Restriction of Customer-data access;
  • Temporary suspension;
  • Removal from particular service areas;
  • Removal from certain service categories;
  • Reduced or discontinued platform visibility;
  • Termination of RenoSync participation;
  • Permanent loss of RenoSync access;
  • Referral to appropriate legal or regulatory authorities where appropriate; and
  • Other contractual or legal remedies.

24. Contractor/Vendor Privacy Certification

By accepting this Privacy Policy, you certify that:

  • You understand RenoSync Customer information is confidential;
  • You will use Customer information only for authorized purposes;
  • You will not sell Customer information;
  • You will not improperly transfer Customer information;
  • You will maintain reasonable safeguards;
  • You will limit access to authorized personnel;
  • You will take reasonable steps to protect Customer information stored on your devices or systems;
  • You will promptly report suspected security incidents;
  • You understand RenoSync may track which Contractor/Vendor received a Customer's information;
  • You accept responsibility for information received through appointments you approve or accept;
  • You will reasonably cooperate with legitimate privacy investigations;
  • You will comply with applicable privacy and data-security laws; and
  • You accept the RenoSync Contractor/Vendor Privacy and Customer Data Policy.

Acceptance of this Policy is required before a Contractor/Vendor may receive Customer contact information through RenoSync.
